Driving With A Suspended License In Oklahoma

In Oklahoma, it is unlawful to drive a motor vehicle on public roads, streets, highways, turnpikes or other public place when a person’s privilege to do so has been canceled, denied, suspended or revoked.

Oklahoma law requires an individual to surrender his/her license if it is suspended, revoked or canceled.

There are stiff penalties for driving without a valid license in Oklahoma.

1. For a first conviction, $100.00 to $500.00;
2. For a second conviction, $200.00 to $750.00; or
3. For a third and subsequent conviction, $300.00 to $1,000.00,

or by imprisonment for not more than one (1) year or by both such fine and imprisonment.

Each act of driving on the highways as prohibited shall constitute a separate offense.^[1]

In addition, penalties increase if the person commits the offense while their license is currently canceled, denied, suspended or revoked:

1. For a first conviction, $500.00 to $1,000.00;
2. For a second conviction, $1,000.00 to $2,000.00; or
3. For a third and subsequent conviction, $2,000.00 to $5,000.00,

or by imprisonment for not more than one (1) year or by both such fine and imprisonment.

Each act of driving on the highways as prohibited shall constitute a separate offense.^[2]

The relevant elements of Driving Under Suspension/Revocation in Oklahoma are as follows:

No person may be convicted of driving under suspension/revocation unless the State has proven beyond a reasonable doubt each element of the crime. These elements are:

First, the defendant drove a motor vehicle upon a public road/street/highway/ turnpike/(public place) in Oklahoma;

[Second, while his/her (driver’s/operator’s license)/(privilege to drive a motor vehicle) was canceled/denied/suspended/revoked.]

OR

[Second, while he/she was disqualified from driving.]^[3]
